Terms of Service

These Terms of Service (“Terms”) are a binding legal agreement between you and Jobalina (“Jobalina,” “we,” “our,” or “us”) governing your access to and use of our website at www.jobalina.com and all related services (the “Service”). By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Jobalina is an AI-powered job search platform. You provide a resume and a job posting, and our system generates four tailored materials: a rewritten resume, a cover letter, a multi-week outreach roadmap, and a personal pitch. These materials are intended as a starting point for your own job search — not as a substitute for your judgment or verification.

We may add, modify, or discontinue features at any time. We will make reasonable efforts to notify you of changes that materially affect your use of the Service.

2. Eligibility and account terms

  • You must be at least 18 years old to use the Service.
  • You may create only one account per person. Multiple accounts used to circumvent plan limits are prohibited.
  • You must provide accurate, current, and complete registration information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at support@jobalina.com.

3. Your content

You retain full ownership of resumes, LinkedIn data, and other content you upload to the Service (“Your Content”). By submitting Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit, and display Your Content solely as needed to provide the Service — including sending it to our AI provider for generation.

You represent and warrant that: (a) you have the right to submit Your Content; (b) Your Content does not infringe any third party's intellectual property or privacy rights; and (c) Your Content is accurate and reflects your genuine background and experience.

4. AI-generated content and no-fabrication policy

The tailored resumes, cover letters, pitches, and roadmaps produced by the Service are AI-generated suggestions. You are solely responsible for reviewing, editing, and verifying every output before sending it to an employer or using it in any professional context.

Jobalina does not guarantee any particular outcome from using the Service, including but not limited to securing interviews, job offers, or employment. Results vary depending on many factors outside our control.

Our AI is instructed never to invent, fabricate, embellish, or add qualifications, roles, dates, achievements, or skills that do not appear in your uploaded resume. It may rephrase, reorganize, and emphasize existing content — but it will not create false experience.

Submitting AI-generated materials that contain false information to employers is your sole responsibility. Jobalina bears no liability for any consequences arising from fabricated or inaccurate content that you choose to submit.

5. Acceptable use

You agree not to:

  • Submit resumes or personal information belonging to another person without their explicit written consent.
  • Use the Service to create misleading, fraudulent, or fabricated employment histories or qualifications.
  • Use the Service to send unsolicited bulk communications (“spam”) to employers or recruiters.
  • Create fake accounts, impersonate others, or misrepresent your affiliation with any person or entity.
  • Reverse-engineer, scrape, decompile, or attempt to extract the source code or proprietary algorithms of the Service.
  • Attempt to overload, disrupt, or otherwise interfere with the Service or its infrastructure (including DDoS attacks and automated abuse).
  • Use the Service in violation of any applicable local, national, or international law or regulation.

6. Plans, payments, and billing

Free tier

Free accounts include one (1) application per calendar month with access to core features. Free tier limits may change with notice.

Pro plan

The Pro plan is currently priced at $49 per month, billed monthly in advance through Stripe. New Pro subscriptions include a 3-day free trial; your payment method is collected at signup but not charged until the trial period ends. Pro subscribers receive unlimited applications and access to all features. Pricing may change; existing subscribers will receive at least 30 days' notice before any price increase takes effect.

Cancellation and refunds

You may cancel your Pro subscription at any time via the Stripe billing portal accessible from your account settings. If you cancel during the free trial period, your subscription ends immediately and you will not be charged. Otherwise, cancellation takes effect at the end of the current billing period — you retain access until then. We do not issue refunds for partial months or unused time, except where required by applicable law.

Failed payments

If a payment fails, Stripe will retry according to its standard retry schedule. If the payment remains uncollected, your account may be downgraded to the free tier until payment is resolved.

7. Intellectual property

You retain ownership of Your Content (your resume, data, and any materials you upload). You also own the AI-generated outputs produced for you — subject to your compliance with these Terms.

The Service itself — including its software, design, branding, trademarks, and underlying models and prompts — is owned by Jobalina and protected by copyright, trademark, and other applicable laws. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. No other rights are granted.

8. Service availability

We aim to make the Service available 24/7 but do not guarantee any specific uptime. The Service is provided on a best-effort basis. We may take the Service offline for maintenance, upgrades, or in response to security incidents. We will not be liable for any interruption, delay, or loss of data resulting from downtime.

9. Termination

You may delete your account at any time from your account settings. Deletion removes your profile and application data subject to our retention policy described in the Privacy Policy.

We may suspend or permanently terminate your access to the Service, with or without notice, if you: violate these Terms; engage in fraudulent or abusive behavior; create legal or reputational risk for Jobalina or other users; or for any other reason in our reasonable discretion.

Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive termination — including AI-generated content responsibility, intellectual property, disclaimers, limitation of liability, and governing law — will survive.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT AI-GENERATED OUTPUTS WILL BE ERROR-FREE, COMPLETE, OR SUITABLE FOR SUBMISSION TO ANY SPECIFIC EMPLOYER.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBALINA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF — OR INABILITY TO USE — THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Jobalina and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and send a notice to the email address associated with your account. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

14. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict-of-laws principles.

Any dispute arising from these Terms or the Service that cannot be resolved informally will be resolved exclusively in the state or federal courts located in Connecticut, and you consent to personal jurisdiction in those courts. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.

15. General provisions

  • Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and Jobalina regarding the Service.
  • Severability: if any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
  • No waiver: our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
  • Assignment: you may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights freely.
